Do We have The right To Appeal Parking Tickets?

Bookmark and Share

Since the days of legalisation in 1990′s the parking control were given to the local councils from the police who has led to a sharp increase in the amount of parking ticket issued to motorists. This in turn has lead to a high increment in parking ticket appeal from the common people.

There are more than a few that believe the city is truly using this for funding, and with the growth of the city and increase in traffic tickets, it is becoming apparent that it’s truly happening.

There are an increasing number of motorists appealing against their parking tickets. And no wonder with the latest increase in parking fines to 120 pounds for some motorists.

If you believe that a ticket was unfairly issued to you, or perhaps that you have been singled out, then you should know that about 50% of all motorists that contest their parking tickets actually come out on top. Believe it or not it is not unusual for the Local Councils to skip the court date.

This is not to say that parking tickets are unnecessary. As a matter of fact it is widely accepted that a lack of parking tickets would cause utter chaos, and the Local Council would not have the budget it needed. In addition to that, the Council Tax would be raised due to a lack of revenue from parking fines.

That is the theory of course, though it may also be that traffic wardens are under increased pressure to hand out tickets.

Avoiding tickets is not difficult so long as you pay attention to where you’re parking, and of course make sure you do not park on a street that prohibits it. This is the leading cause of parking tickets, and so long as you’re able to stray away from such activity, there is no reason you should be receiving a parking ticket-at least not a legitimate one.

To appeal for a parking is not a very hard procedure. But in spite of these easy steps 99% people are still paying their parking fine. All it takes a simple 10minute consuming letter to the local council or if you are lucky then one very quick and easy email.

So just sitting down and writing a 10minute email or letter to save 30-120 pounds is too much hassle for you? Of course it is not. The fact is that majority people do not realise its easy and smooth concept. This a website where parking ticket appeals comes into its own. This website will provide you out with a template letter or even appeal in terms of you.

To make the parking approach successful and making the letter a nice one to appeal to the officials you need to provide evidence that the ticket issued is legally invalid. Instances like photographs of the evidence that the incident didn’t even occurred for which he is being charged like there were no signs or markings so that he could know it was a no parking zone. With almost two thirds of parking tickets being issued illegally, there stands a high chance of success.

Other than this usage of evidence gathered from photograph one can also use some technicality to aid n appealing a parking ticket. Generally a technicality involved applies to doing what is written on the parking ticket. For instance if you got a ticket which says you were parked in Smith Street when in fact you were parked in Smith Road then you could probably argue that the blame imposed is wrong or it never occurred thus letting your major chances of winning your parking ticket appeal.

A relatively new phenomenon is appealing for parking tickets towards private parking ticket companies. Under these companies you get similar ticket as the warden gives you but it will say something distinctive from the original and legal issued one as “Parking Charge Notice pay within 14 days for a reduced rate. Non payment will result in us contacting the D.V.L.A. for your details.”

Its an appeal that please do not give bothering to these private parking tickets. In most cases if you write to them they wont receive your appeal and will turn down your offer for a legal parking ticket. The reason for discouraging is that they will constantly pest you with empty threats because these are not parking tickets but illegal invoices.

To make my point clear on this one such company Euro Car Parks to my knowledge has never taken anyone to court over non payment over one of their so called parking fines. If any such company did take you to court then they would have to prove that you as registered keeper were party to any contract (when you enter their car park you enter in to a contract). That is they would have to prove you were driving the car at the time. Even if they could prove it were you driving all they would be entitled to be the amount you should of paid e.g. 2 pound for an hours extra parking.

In other words, don’t pay these parking tickets regardless of the threatening letters. They will go away if you ignore them, and if they do not go away, then simply send them a letter stating that you will sue them for harassment. Never make a payment on these tickets until you are absolutely certain they come from a reputable source.
